GENERAL CONDITIONS OF SALE 

1) General indications

All orders are understood to be made under the following conditions, none excluded, which the purchaser expressly declares to know and accept. All orders are valid as a purchase offer even if they are made following an offer by Blaumann s.a.s and the relative purchase agreement is finalized exclusively with confirmation by Blaumann s.a.s.  Blaumann s.a.s through the order confirmation only recognizes the sales conditions indicated below, or with these non-conflicting conditions. Any conditions or clauses indicated in the purchase order, if different or conflicting with respect to those indicated below, will not be considered accepted in any way. The order confirmation issued by Blaumann s.a.s does not imply in any case the acceptance of clauses or conditions where these have not been expressly recalled and accepted in the aforementioned confirmation document. 

2) PRODUCTS

Information regarding the products displayed on the ProCyclingPoint.com website is obtained directly from the producers of the products themselves. The descriptions are purely indicative and may change for each product without prior notice. We are not responsible for any errors (due to our causes and / or producers) in these descriptions. 

3) ORDERS

Blaumann s.a.s accepts orders for goods on the procyclingpoint.com website, also via traditional channels. Once the order is placed, the buyer will receive a confirmation e-mail containing all the details of the sale.

 

4) PAYMENTS METHODS

1. Advance Bank Transfer: Once purchased, you will receive the bank details on which to make the transfer. To speed up delivery times, please send a copy of the bank transfer to [email protected]. The order will be processed and shipped only once the credit has been credited to our account. Each commission incurred for wire transfers will be charged to the customer. This cost varies depending on the contract you have with your bank. 2. PAYPAL: Once the purchase is made, you can make the payment by accessing the SECURE PAYPAL portal (with encryption of the transmission of your data) where you can register and  pay by Paypal or credit card. Blaumann s.a.s. is not responsible for the truthfulness of such information and reserves the right, if it finds abuse or fraudulent use, to inform the competent authorities.  

 6) V.A.T.

All prices displayed on the ProCyclingPoint.com website are inclusive of VAT. Prices can be changed at any time without prior notice, at the discretion of Blaumann s.a.s.

 

7) RESPONSIBILITY · Blaumann s.a.s. is not responsible for any direct and / or indirect damage deriving from the use of the goods sold through the ProCyclingPoint.com website · Blaumann s.a.s. is not responsible in any way for the fraudulent and illicit use of its site and its services and for any type of payment by third parties 

8) SHIPPING

Blaumann s.a.s. sends goods covered by insurance, and is responsible for the goods until the moment of delivery, to the final recipient, which will be traceable from the courier's website. We are not responsible for any delay in the delivery of products. Upon delivery of the order via our courier (selectable from those available when ordering), the recipient or customer of the order is required to verify the integrity of the package and that the number of packages delivered to him corresponds to the number (of packages) indicated on the waybill. In case of discrepancy, please contact the courier to accept the package with RESERVE and report it immediately via the Contact Us section or by email to [email protected] The customer is directly responsible for the veracity of each statement sent. In the event that it is impossible to deliver the package (for example, for incorrectly communicated address, recipient absent) and this package will return to us, the shipping costs will be borne by the buyer, including those for further sending. A telephone number is therefore obligatory for the finalization of the delivery. 
9) RIGHT OF WITHDRAWAL:
 Sales of products via the Internet are governed by Articles 45 to 67 of Legislative Decree 206/2005 (Consumer Code). This legislation provides the consumer with the right to withdraw from contracts or contract proposals, guaranteeing him the right to return the purchased product and to obtain reimbursement of the expenses incurred. The right of withdrawal does not apply to audiovisual products and sealed computer software products opened by the consumer, nor to sealed goods that can not be returned for reasons of hygiene or health protection that have been opened after delivery. The Customer is only responsible for the decrease in the value of the goods resulting from a different handling than necessary to establish the nature, characteristics and functioning of the products, namely: - in the absence of the original packaging; - in the absence of integral elements of the product (accessories, cables, instruction manuals, etc); The right of withdrawal is reserved exclusively for consumers (natural persons who purchase the goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore can not be exercised by legal persons and by natural persons acting for purposes related to the activity professionally carried out. The costs of returning the product are charged to the customer. Methods and timing for exercising the right of withdrawal The Customer has a period of 14 (fourteen) days to withdraw. The withdrawal period ends after 14 (fourteen) days from receipt of goods or, in the case of services, from the conclusion of the contract. Within this period the Customer must inform Blaumann s.a.s. the desire to withdraw from the contract with one of the following methods: 
- delivering the product at our office in:

Within 3 (three) working days of receipt of the notice of withdrawal, Blaumann s.a.s. will send the Customer a confirmation email in which the return of the goods is authorized. Within 14 (fourteen) days of receipt of the confirmation email, the Customer will, at his own expense and expense, send the product carefully packed.

Via Vergnano, 16 - 25125 Brescia (BS) The deadline is considered respected if the Customer delivers the product before the expiry of the period of 14 (fourteen) days. Methods and timing of refund to the customer of the cost of the product and shipping costs Pursuant to Article 56 of Legislative Decree 206/05, if the customer withdraws from this contract, all payments made to us will be reimbursed, including delivery costs (with the exception of additional costs resulting from the choice of a type of delivery different from the less expensive type of standard delivery offered by us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. The refund may be held for more than 14 days only until the shipment of the goods is proven or until we have received them, whichever situation occurs first. Refunds will be made using the same payment method used to purchase the product. In the case of a purchase paid by cash on delivery, the refund will be made by bank transfer and the customer will be contacted to provide the bank details necessary for the operation.  10) RIGHT OF CONFORMITY
Pursuant to Legislative Decree No. 24 dated 02-02-2002, Blaumann s.a.s. is liable to the consumer for any lack of conformity existing at the time of delivery of the goods.
 The lack of conformity is found for:  · Malfunction  · Internal transport damage not found at receipt;  · Incorrect shipping; 
The lack of conformity must be reported within 26 months after the date of purchase; this term derives from the duration of the guarantee, which is 24 months plus 2 months, which is the time limit within which the product defect must be notified from the moment it is manifested. It is necessary to keep the fiscal document certifying the date of purchase.
 The warranty will apply to the product that has defects of conformity and / or malfunctions not found at the time of purchase, provided that the product is used correctly and with due diligence, respecting its destination and as provided for in any technical documentation , with observance of the various operating regulations indicated therein. This guarantee will not be applicable in case of negligence, carelessness in the use and maintenance of the product. In case of lack of conformity, the consumer has the right to the restoration, of the conformity of the goods by repair or replacement. The guarantee is personal and will therefore apply only to the original purchaser, being reserved to direct customers and not to dealers and retailers.  The shipping costs for the outward and return at our warehouse, however, are charged to the customer.

 

Procedure for exercising the right of recovery a. If the product purchased at our site has some operating defects, to obtain the restoration of the consumer goods and make it compliant with the contract of sale, follow this simple procedure: b. Within 26 months of receipt of goods, send notice to Blaumann s.a.s. by e-mail linking to the "Contact us" section of the site or by phone by calling the number 0303542218 or by email to [email protected] indicating the defect of the product. c. Prepare the product for shipping carefully packed. The use of the original packaging and the insertion of every accessory, the instruction manuals and all the content originally contained will speed up the restoration of the lack of conformity. Received and checked the returned product, we will restore the lack of conformity according to the agreements made.

 


11) WARRANTY

All products on sale on Procyclingpoint.com, are covered by the official guarantee of the manufacturer in accordance with the regulations, as applicable, referred to Legislative Decree No. 24 of 02-02-2002. This guarantee will apply to the product that has conformity defects and / or malfunctions not found at the time of purchase. The guarantee is personal and will therefore apply only to the original purchaser, being reserved to direct customers and not to dealers and retailers

 

12) DISPUTES


We inform the Consumer resident in Europe that the European Commission has established an online platform that provides an alternative dispute resolution tool.

 This tool can be used by the European Consumer to resolve in a non-judicial manner any dispute relating to contracts for the sale of goods and services stipulated in the network and / or deriving from them.
